Need some thoughts guys ??
« on: June 13, 2005, 05:33:13 AM »
I have a problem with a buyer who i will leave unknown at this time.
I sold a ball to this person on Ebay, It was a Morich Onslaught. I never had the ball placed on a scale to know the exact lb's & oz's. I bowl with a 15 most of the time. I listed the ball as a light 15lb due to that i was able to tell it was a little lighter then my equipment i was throwing at the time.
I sold the ball for $30.00 + $15.00 for shipping $45.00 total. The buyer sent me a email approx 2 weeks after the sale , Explaining that i owe him $100.00 for the ball. He took the ball and had it completly plugged and redrilled and while it was being redrilled the proshop guy told him it was a 14lb ball ? The only time i had the ball weighed was at the UPS store when it was being shipped. and it weighed 15lb . I dont think a standard size bowling ball box d weighs a whole pound. How ever If he would have had it weighed and contacted me before any work was done, I would have refunded him. I have a 100% score on ebay and a good name on here , And i don't need to have some one ruin it. As well as giving someone $100.00 for a ball i sold for $30 + shipping and Now it has been Plugged and redrilled.
I have responed to the Claim dept on Paypal , But i would like to here your thought about this.

Did he say how heavy a "14" the ball was when he weighed it? I think he's being a jerk and even if he gives you one bad mark, just explain it and you'll be fine. Some people are just jerks, etc.....

There is no way the guy should get anymore of a refund than the original purchased price, period..

That's what I would like to know?  Why does he say you owe him 100 dollars?  That's ridiculous, and I wouldn't worry too much about it, the guy sounds like he is taking you for a ride.

Sounds like an honest mistake, I don't know why the person feels they are entitled to anything but the original monies they were out.

Thanks for the response guys, The claim form i had to fill out stated that the funds in the amount of $45.00 is being put on hold until the matter is resolved. How is that possible almost a month after the purchase was made ? Anyway i have nothing to hide or be afraid of I sold a ball that was in great shape for a very cheap price. And the winning bidder is being a real butt .Think about this guys , He was willing to buy a light 15lb ball , light meaning under 15lbs OK so lets say he thinks it is 14-8 , but it is really 14-3 or 14-4 . whats the big deal .... It is only a few ounces ?????????? Get over it. After this matter is resolved i will tell you guys who this is ?
I am not sure if he is a user here , although i think i seen his name here before.

Those are the rules for PayPal's buyer protection --- READ IT! It is in your best interest to know what PayPal will and will not provide coverage for - know it to protect yourself when buying and also how to protect yourself when selling!

You may be able to argue that under the "Claims" section (sec 4,a, 2, iii) that "The description could have been reasonably misinterpreted by the buyer or the seller. For example, if the item is a different color than advertised (e.g. the item is aqua-marine but was advertised as teal);" - your definition of "light 15lb" may be different than the buyer's definition.

You could also argue that the buyer has significantly altered the item (by having it plugged and re-drilled) and the item is now worth even less than originally sold (at least worth less to you).  The buyer should have contacted your before making any alterations to the item - the item is no longer in the condition it was received.

You could also just offer to refund partial money to the buyer - if they accept the situation is considered resolved.  If you are that worried about it, refund the shipping - maybe the guy will be happy to get $15 back.

IMO, if the buyer was worried about the weight he/she should have had the ball weighed before it was plugged and re-drilled.

Look at it this way - if PayPal determines the other guy is entitled to a refund, he will have to pay to ship the ball back to you.  When you receive it you can complain that the ball is not in the same condition as when you shipped.  Also, the guy spent $45 on the ball, another $40-50 for the plug and re-drill, and add another $10-15 for shipping it back to you.  The most he will get refunded is $45, so he will be in the hole for $55-60 (I don't even know if PayPal will refund your shipping costs???).  That's something to think about.  Tell the guy to ship the ball back and refund his money - he will be out $50-60 with nothing to show for it.

Minus shipping!

BUT you should have weighed the ball first!
especially a ball that you were suspicious of to begin with.

He also has a dimwit for a driller if he told him that after plugging it that it was 14 lbs. You weight it before you do ANYTHING.

sounds like you need to offer him a partial settlement...mistakes on both sides.  offer half and let him keep the ball.

I wouldn't worry to much about it. I sold a ball on E-bay and sait it had around a 4 1/2" span when the guy got it he said he wanted his money back because the ball was closer to 4 1/4" span. I told him tough luck the ball was sold "as-is".

Shouldn't the driller have weighed it before he did the plug and redrill?

John,

You should have weighed the ball before you sold it. That is your mistake.

However, since he altered the ball I don't think you owe him anything.

Thanks,
Donald

I don't know how you shipped, ie: double boxed etc, I always ship double box . The weight of a regular 9X9X9 bowling ball box is 7.3 oz. IF, and I say IF you double boxed you are then close to 1 pound. USP and FedEX weighs things and takes them UP to the next pound. If you were told, at UPS, 15 pounds, then the ball was in fact a 14 lb ball, it might have been a 14'heavy', but it was a 14 lb ball.

The part of you oweing him...I'm not touching that part of it with a 10 ft pole, I'm out of that part.
