What should I do??????
« on: May 09, 2009, 01:53:23 PM »
My league had the paid out last week, which I missed because of work.  I missed the last 8 weeks, but paid the full league off in full right after Christmas.  Since I didn't show up for the pay out, the team captain gave my share($85) to the sub.  I had explained to the league secretary(also on my team) and my team captain why I would not be there and to give my share to the pro shop owner to hold for me.  What should I do?  I didn't like bowling with this team so I'm really not worried about hurting feeling!  But I do like bowling there and this league.

Since you paid all the bowling fees, I would go and demand my money NOW!  IMHO, being as the sub PAID nothing, they should RECEIVE nothing. The money should be divided amongst those who paid it in in the first place.

P.S. I went to Bowl.com and looked in the rule book, and did a search for disbursement of prize. Under the results came a list of responsibilities of the league officers AND team captains. Here is a direct cut&paste from that page with the interesting part underlined in bold type:

Team Captains

Team captains are league members who may organize and enter teams. They represent their team and, unless they designate another, serve on the league’s board of directors.

Team Captains in Adult leagues are responsible for:

« Collecting USBC membership dues from team members, and forwarding them to the league secretary.

« Collecting league fees from team members and forwarding them to the league treasurer.

« Ensuring the team and its members are eligible to compete under USBC and league rules.

« The teams conduct and attendance.

« Entering the team members’ names in the lineup before the league series begins.

« Computing the scores, signing the score book and securing the opposing team captain’s signature.

« Distributing the prize fund to team members within 15 days of receipt.

It clearly states TEAM MEMBERS, not substitutes.  If he failed to give me my money, I would file a protest and see what happens.

I have NEVER requested money for subbing and never will. As a team, in full agreement, we have given a dependable sub a small share from each of our winnings (last year we each gave him $20, so $100 total for helping us out). I really don't know if the league secretary would be able to help you out, but I would definitely give the team captain a few stern words and also ask for your appropriate share, even if it comes from his own pocket.

My wife thinks I should go to the center and tell the owner, my team captain's brother, that because of the b.s. I'm taken my business to the other center in town.  I also just talked to the team I'm suppose to bowl with in the summer and next winter they said they would go to the other center with me.  They are kind of riding the fence of doing that anyway, for other reasons.  Who should I talk to for the best results?

Here is my take on this. It seems like someone thinks that they can do as they wish with NO repurcussions. You, as an individual, can influence little, and threats by you would only serve to either make things worse or get you humiliated.

Like I said, I would go to the team captain, who is responsible for the disbursement of the prize money, and tell him I wanted MY money. If he just tries to "blow it off", inform him of exactly what I have told you and let him know that you are going to file a protest/complaint with the U.S.B.C. if you don't get YOUR money.

Meanwhile, contact the U.S.B.C. and find out the proper ruling for this situation. If the U.S.B.C. sides with you, the guy could lose his sanction and not be able to compete in leagues until further notice. Also, if the owner tries to stick his nose in, tell him since the guy is his brother, you will also let the U.S.B.C. know that you think it was a case of collusion between the center owner and the team captain to keep you from getting your money and the HE, as well as his brother, will be named in your complaint/protest and that if the U.S.B.C. finds in your favor, the BOWLING CENTER could lose its sanction completely.

Contact U.S.B.C. first and see what the initial response is. If it is favorable to you, you might just show them the initial letter and they might be willing to pay up without much trouble.

P.S. Me, I would tell the guy he owed me the money and I was either going to get it in cash, or I would take it out of his a-s-s, however he wanted it.

I have emailed USBC waiting for a response.  I truthfully don't want to bowl at the other center.  I just don't know who I should talk to or go about fighting the problem.

I'd talk to the secretary and the team captain, they were on your team.  Talk to the sub also, he paid in nothing, is due nothing.

Don't make the threats of walking.  Just do it after you get YOUR money.

There's always small claims court. I can't believe a judge would side against you. Then if you don't get your money a judgment will be lodged against the team captain since by USBC rules it's his responsibility to give you your money. You don't need a lawyer but bring all pertinent information to make your case. That team captain is a real d-bag. I'd like to see him try and explain to the judge why  he paid the sub.

I'd talk to the sub directly first.  He should have known since he wasn't paying league fees that he wouldn't be receiving a cut of the payout.  Otherwise, I'd agree with Mike Austin.  The treasurer and/or secretary and your team captain dispersed the funds.  Why was the sub even at the meeting?  Anyway, the owner had nothing to do with the problem, so don't be a PITA to him.

You should have been given the money, no one else. I have had, over 3 years, members leave, military requirements, and I always split the winning share by the two members percentage of bowling. These were 'full members' no subs.

I personally don't feel a sub deserves anything, unless that sub is listed as YOUR team sub only. Then, depending on the number of total games he/she bowled for the team, maybe a percentage of share, maybe.

USBC will not help you as the Team Cpt is responsible for the team shares, but good luck. I'd sure have a talk with the Cpt, explain your feeling of what you feel you are owed, then if he doesn't make it right, go to the Board.

Well, here's a nice little update!  This morning I've talked to the secretary and the league president which have both talked to the team captain. He claims he had no way to get into contact with me and, since I "dropped of the face of the earth" he didn't know what to do.  So he did what he did, even though he knows the pro shop owner is my best friend and my neighbor.

The reason the sub was there is because the league paid off at the end of the position round that night.

Thanks to the president I did find out who the sub was.  The president said he would help fix this problem and talk to the sub.

He can "say" anything, now that it's been done, but being HIS responsibility, HE should have just kept the money HIMSELF until he heard from you. I was in this position a few years ago and held a guys money for 15 months until he finally got hold of me and told me where to send it.

$85 isn't much, but it is YOUR $85, and HIS responsibility to see that YOU got it and nobody else.

Hopefully, this works itself out peaceably. Good luck.

Hopefully it will work out since you have more information now.  You didn't even know who was subbing for you?  I guess another team mate set it up?  Even more odd that your league allows subs for a position round.  Some leagues allow it, but very few do.
